I have attached Cucamonga Valley Water District's comments regarding the July 23rd workshop held by Watermaster to discuss implementation of the Dry Year Yield Appellate Court Ruling.

  • MVWD resubmits its letter, dated January 25, 2022 (attached), responsive to Watermaster's request at that time for advice and assistance concerning the DYY Program. The points MVWD raised in our 2022 letter should be addressed by Watermaster in its implementation of the recent Appellate Court ruling. Specifically:
    • Consider revisions to the DYY Program implementation in the FY 2021/22 and 2022/23 Assessment Packages that returns the Program's focus onto imported water supply reliability. This may include application of the Imported Water Baseline provisions of Exhibit "G," as amended in 2015, to all DYY Program production after 2015.
    • Obtain consensus on how Watermaster assesses groundwater production, including storage withdrawals and Desalter overproduction. Such agreement may apply differently to past assessment packages in deference to business decisions made at the time, but it must be applied consistently going forward.
    • Adopt new Watermaster Rules and Regulations that directly address shortcomings identified in the Appellate Ruling regarding Watermaster's oversight of the DYY Program and Storage and Recovery Programs generally.
  • The DYY Operating Committee should be convened and provide advice to Watermaster on how best to correct and amend the FY 2021/22 and 2022/23 Assessment Packages consistent with the original DYY Program agreements.
